Criminal Set Asides

Nebraska law provides for some misdemeanor or felony conviction or infractions to be set aside if the person satisfactorily completed a term of probation or paid a fine as a sentence. In some instances, if you are sentenced to less than one year of imprisonment, the court may also grant a set side. A set aside is an order by a court that means you successfully completed your sentence and you are rehabilitated. A set aside does not remove a conviction on your record. Instead, Nebraska adds a notation that the record is set aside. But it does nullify the conviction, removes all civil disabilities and disqualifications imposed as a result of the convictions, and may restore an individual’s ability to legally possess or own a firearm. However, the conviction is not sealed and is not sealed from the public and still has some legal consequences. In determining whether to set aside the conviction, the court considers the behaviors of the offender after sentencing, the likelihood that the offender will not engage in further criminal activity, and any other information the court considers relevant.
